Stored Value Facility Payment Specific Terms & Conditions

Unless otherwise stated by O-RID, these Payment Specific Terms & Conditions shall apply to the Customer and form part of the Contract with the Customer where the Customer is required by O-RID to make payment for the Service by way of Stored Value Facility. In the above regard, these Payment Specific Terms & Conditions together with the General Terms & Conditions and the Registration Page form the contract between the Customer and O-RID for the use of the Service and applies to the Charges payable by the Customer in connection with O-RID's provision of the Service. The Customer will be conclusively presumed to have notice of and have agreed to be bound by the most recent version of the terms and conditions of the Payment Specific Terms & Conditions as modified by O-RID from time to time. The Customer agrees to comply with any restrictions imposed by any applicable laws of its specific jurisdiction prohibiting the Customer from purchasing pre-paid tickets. By purchasing pre-paid tickets, the Customer represents that it is in a jurisdiction which does not prohibit the purchase of pre-paid tickets. The Customer is solely responsible for compliance with the laws of its specific jurisdiction regarding the purchase of pre-paid tickets.

  1. DEFINITIONS AND INTERPRETATION
    1.1
    In these Payment Specific Terms & Conditions, the following words and expressions shall have the following meanings:
    General Terms & Conditions
    means the general terms and conditions prescribed by O-RID with respect to the provision by it of the Service and that may be posted by O-RID on its website at http://www.o-rid.com/en/term/reglar_term.html including any revised or amended version of the same as issued by O-RID from time to time and that may be posted on the said website. Such revised or amended version of the same shall apply to Customer and the Customer is deemed to have accepted the same, from the time it is published on O-RID's website.
    Payment Specific Terms & Conditions or Stored Value Facility Payment Specific Terms & Conditions
    means these specific terms and conditions prescribed by O-RID with respect to the Charges payable by the Customer in connection with the provision of the Service by O-RID and which forms part of the Contract between O-RID and the Customer and that may be posted by O-RID on its website at http://www.o-rid.com/en/term/ticket.html, including any revised or amended version of the same as issued by O-RID from time to time and that may be posted on the said website. Such revised or amended version of the same shall apply to Customer and the Customer is deemed to have accepted the same, from the time it is published on O-RID's website.
    Stored Value Facility
    means a facility (other than cash) in electronic form which is purchased by the Customer to be used as a means of making payment for Services up to the amount of the stored value facility that is available for use under these Payment Specific Terms & Conditions.
    1.2
    All other capitalized terms not defined herein shall have the meanings ascribed thereto in the General Terms & Conditions.
  2. Scope of Agreement
    2.1
    The use of the Service is subject to the General Terms & Conditions and these Payment Specific Terms & Conditions. These Payment Specific Terms & Conditions shall be governed by the terms and conditions of the General Terms & Conditions.
    2.2
    These Payment Specific Terms & Conditions are in addition to, and do not modify the General Terms & Conditions. If these Payment Specific Terms & Conditions are in conflict or inconsistent with the General Terms & Conditions relating to the Charges and payment of such Charges, these Payment Specific Terms & Conditions prevail to the extent of the inconsistency.
    2.3
    The Customer agrees to be bound by and to fully observe and comply with all the provisions of the General Terms & Conditions, these Payment Specific Terms & Conditions, as well as such other terms and conditions as may be agreed between O-RID and the Customer in writing.
  3. Charges and Stored Value Facility
    3.1
    The Customer shall purchase pre-paid tickets on the Stored Value Facility in advance and then pay the Charges with the pre-paid tickets on the Stored Value Facility in consideration for the Service provided to the Customer by O-RID.
    3.2
    The Customer agrees that upon the Customer's use of the Stored Value Facility as a means of payment for or a transaction in relation to the Service, O-RID shall be entitled to deduct payment for the Service provided by O-RID to the Customer from the Stored Value Facility, in such manner as may be determined by O-RID.
    3.3
    The Charges and amount of pre-paid tickets payable for each instance of use of the Service shall be as determined by O-RID, and may be amended by O-RID from time to time by O-RID posting such amended Charges on its website. Such amended Charges shall apply to the Service and the Customer agrees to pay for the Service based on such amended Charges from the time that such amended Charges have been posted by O-RID on its website.
  4. Transactions
    4.1
    The pre-paid tickets on the Stored Value Facility shall be used as a means of payment for a transaction in relation to the Service. During such payments and/or transactions, the pre-paid tickets on the Stored Value Facility shall be reduced by the number of pre-paid tickets corresponding to the Charges for the payment or transaction payable by the Customer to O-RID.
    4.2
    Notwithstanding the aforesaid, O-RID shall not be liable for any loss, cost or damage suffered, if any, by the Customer and O-RID may reject the use of the Stored Value Facility for effecting payment for a transaction in relation to the Service if :
    • the Stored Value Facility is suspected by O-RID to be a counterfeit, or to have been fraudulently or illegally issued or revalued or to have been stolen or tampered with in any way; or
    • the Stored Value Facility is insufficient or has been exhausted; or
    • there is any breakdown in the payment system or part thereof which disables O-RID from accepting or processing the Stored Value Facility as a means of effecting payment or a transaction in relation to the Service; or
    • O-RID determines the use of the Stored Value Facility poses a risk to the payment system.
  5. Charges
    5.1
    O-RID shall be entitled to impose a charge for the Customer's use of the Service. Any such charge shall be deducted from the pre-paid tickets on the Stored Value Facility.
  6. Refund
    6.1
    Unused pre-paid tickets once purchased from O-RID may only be refundable (less such administration charge as may be imposed by O-RID) at the time of termination of the Contract, provided that the Customer indicates at the time of termination that it wishes to have the refund. Save for the aforesaid, unused pre-paid tickets are not refundable. There will be a refund of unused pre-paid tickets but there will be no refund of the Charges payable for the Service. There will not be a refund of unused pre-paid tickets where the unused pre-paid tickets is less than the equivalent administration charge imposed by O-RID. The Customer shall not be entitled to a refund of unused pre-paid tickets after the date of termination of the Contract or where Customer did not indicate at the time of termination of the Contract that it wishes to have the refund, whereupon the Customer shall have no claim whatsoever against O-RID.
    6.2
    Notwithstanding the Charges, and such other fees or charges, if any, as may be imposed from time to time by O-RID for the Stored Value Facility, the underlying facility of the Stored Value Facility remains the property of O-RID and/or its rightful owner and shall be promptly returned to O-RID upon request by O-RID subject always to the Customer's right to a refund of the pre-paid tickets in accordance with these Payment Specific Terms & Conditions.
    6.3
    O-RID shall be entitled without assigning any reason therefor to retain and/or suspend any Stored Value Facility which is reasonably suspected to have been fraudulently issued or acquired, or is reasonably suspected to have been tampered with.
    6.4
    O-RID may in its sole discretion retain and/or cancel any Stored Value Facility at the same time or after a full refund of the Stored Value Facility has been made to the Customer and the Customer shall have no claim whatsoever against O-RID.
    6.5
    The refund of the Stored Value Facility shall be made in accordance with such procedural or operational requirements as O-RID may from time to time prescribe by publishing the same on O-RID's website at http://www.o-rid.com Any failure by the Customer to observe or comply with such procedural or operational requirements may result in delay in processing any refund or disentitle the Customer from receiving a refund of the unused pre-paid tickets in the Stored Value Facility.
    6.6
    Notwithstanding anything herein contained, O-RID shall not be liable to make a refund of the Stored Value Facility if the Stored Value Facility has been fraudulently issued or acquired or has been tampered with whether intentionally or otherwise (as determined by O-RID).
  7. Refund Location

    The Customer may effect the refund of the Stored Value Facility during business hours on Working Days on O-RID's website at http://www.o-rid.com or the Service's website or at such websites or locations as may from time to time be specified by O-RID or at such other premises as O-RID may from time to time specify or by such means as determined by O-RID.

  8. Changes in Terms

    O-RID may, at its sole and absolute discretion, modify the terms of these Payment Specific Terms & Conditions at any time by publishing the same on O-RID's website at [http://www.o-rid.com] or the Service's website. It is the Customer's responsibility to review the terms of these Payment Specific Terms & Conditions from time to time, particularly if the most recent revision date is after the date on which the Customer last reviewed them. Any changes will become effective on the date of publication on the said website as specified therein. For the avoidance of doubt, if the Customer accesses or uses the Service after publication on the said website of a change in this Payment Specific Terms & Conditions, the Customer will be bound by all such changes.

  9. Liability of O-RID

    Subject to the provisions of these Payment Specific Terms & Conditions (including but not limited to provisions such as clause [6.1], O-RID as the holder of the Stored Value Facility under the Payment Systems (Oversight) Act (Cap. 222A, Singapore) is only liable to the Customer in respect of the refund for the unused pre-paid tickets of the Stored Value Facility without any interest accruing.

  10. Issuance and Purchase of Pre-Paid Tickets
    10.1
    The Customer shall examine the Stored Value Facility upon purchase of pre-paid tickets and each time that the Customer purchases pre-paid tickets on the Stored Value Facility. The Customer shall be solely responsible for ensuring that the pre-paid tickets therein is accurate and corresponds to the amount loaded on the Stored Value Facility. O-RID shall not be liable to the Customer for any error or omission not drawn to O-RID's attention upon the purchase of pre-paid tickets on the Stored Value Facility.
    10.2
    The purchase of pre-paid tickets on the Stored Value Facility and/or the subsequent use thereof by the Customer shall be deemed to be acceptance by the Customer to these Payment Specific Terms & Conditions and such notices, guidelines, rules and directions in respect of the use of the Stored Value Facility as prescribed or published by O-RID from time to time.
  11. Determination of stored value
    11.1
    For the purpose of determining the value of the Stored Value Facility in the event of a refund from O-RID pursuant to the terms hereof, the value as determined by O-RID from the value recorded in the Stored Value Facility of O-RID's central records shall, save for manifest error, be deemed conclusive and binding against the Customer.
    11.2
    Subject to the provisions of these Payment Specific Terms & Conditions, the Customer shall, upon receipt of the refund, be deemed to have accepted the amount thereof as entirely correct and conclusive, and agrees to discharge O-RID from any loss, damage, expense and/or liability whatsoever.
